TRAINING AGREEMENT

Training Agreement Terms

The client wishes to engage the dog trainer as a contractor to undertake the services as set out on the dog training plan. Signing the Application for Training is agreement to these terms.

AGREEMENT TO HOLD HARMLESS, WAIVER AND ASSUMPTION OF RISK

I understand that dog obedience training and behavior modification is not without risk to myself, members of my family or guests who may attend, or my dog, because some of the dogs to which I may be exposed may be difficult to control and may be the cause of injury even when handled with the greatest amount of care.

All dogs are individuals and their learning will progress at a variable rate. There are no guarantees that the dog will be able to learn, only that the lessons/instruction will be given. Dogs are either learning or forgetting, so a maintenance program must be followed if the dogs are to retain what they have learned. Several courses/sessions may be required to achieve desired results. Training equipment may be required to achieve desired results.

PROOF OF CURRENT VACCINATIONS MAY BE REQUIRED. Training Applications are taken on a first come, first served basis. We reserve the right to dismiss WITHOUT REFUND, any handler for failure to abide by the rules as stated by Pawz-itive Dog Training’s orientation, handlers’ failure to control the dog, handler abuse of dog, and/or dangerous behavior of dog.

I hereby waive and release Pawz-itive Dog Training hereinafter referred to as the “Training Organization”, its shareholders, employees, officers, members, agent, and any and all representatives from any and all liability of any nature, for injury while attending any training session, or any other function, of the Training Organization, or while on the training grounds or the surrounding area thereto.

In consideration of and as inducement to the acceptance of my application for training by this Training Organization, I hereby agree to indemnify and hold harmless this Training Organization, its owners, employees, officers, members, agents and any and all representatives from any and all claims by any member of any family or any other person accompanying me to any training session or function of the Training Organization, or while on the grounds or surrounding area thereto as a result of any action by any dog, including my own.

Terms & Conditions

Relationship and Responsibilities

1.1. The dog trainer agrees to provide training lessons, to teach the client how to train and work with their dog in an effective manner.

1.2. The dog trainer can utilize tools such as: food, toys, slip leads, harnesses, prong collars, e-collars, and many other training tools as long as the client ethically uses the equipment. Owner also understands certain tools aren’t appropriate for every dog; depends on the dog’s responsiveness to the tool and personality of the dog.

1.2.1. If not willing to utilize rewards and training tools, results aren’t guaranteed.

1.3. The trainer will make all reasonable efforts to help the client achieve the desired goals outlined on the dog training plan, but can provide no guarantee on the dog’s performance and behavior as a result of providing dog training and/or behavior consultation.

1.4. The client agrees to follow the trainer’s instructions, without modifications, and to ensure that the methods are practiced as advised by the trainer.

1.5. Client is aware that if training is not practiced on a regular basis at home, between sessions or after completion of any training program, training is not guaranteed. Training must be maintained.

1.6. The client is responsible for making the dog trainer aware of any medical conditions the dog has.

1.7. The client will be contacted if the dog trainer is unavailable due to unforeseen circumstances. A discount on future sessions or a full refund of the session will be credited to your account.

1.8. The client must ensure the dog has an appropriate fitting collar and name tag for all sessions. The client must supply leads, collars, and/or toys that are in good working order. Also, an appropriate fitting muzzle, if required. Collar and/or lead cannot be used if there are tear(s), hole(s), or the integrity of the material is in question.

1.9. Client understands that for best results trainer may ask that the dog is not fed within 12-24 hours of scheduled session unless the dog has health issues that require them to eat every 8 hours. A hungry dog is a motivated dog.

Indemnity and Liability

2.1. If the client’s dog runs away, breaks free from collar, leash, or any training tool the dog trainer assumes no responsibility for the actions of the client’s dog. The dog remains the sole responsibility of the client.

2.2. The dog trainer accepts no liability for any damage caused by the client’s dog during the period of a dog training consultation, or training session.

2.3. The client will compensate the dog trainer against any injury, or damage caused by the client’s dog towards any other person, including the dog trainer, or any other animal. This will include medical, veterinary or legal fees incurred as a result of damage, injury or death by the client’s pet.

2.4. The dog trainer accepts no liability for equipment; leashes, collars, or any other training tools should these items break, causing the dog to escape, irrespective whether equipment belongs to the dog trainer, or the client. However, the dog trainer will make every effort to minimize and advise against the use of potentially faulty equipment.

2.5. The client accepts that even if their dog is fully vaccinated, their dog can still contract canine diseases including kennel cough, canine flu, and other illnesses. The dog trainer accepts no liability for the client’s dog contracting canine diseases, irrespective of whether the dog is vaccinated, or not.

  1. Application & Medical Conditions

3.1. The client will need to complete a dog training application form which will provide our team with essential information.

3.2. The client must provide our team information on any medical conditions and/or special needs that may affect the duties of the dog trainer and training process.

3.3. Client must provide medical records stating the dog has seen a vet within an appropriate and safe amount of time prior to boarding with PDT

Dog Training Payments

4.1. The dog trainer will charge the client fees, as quoted prior to training for Training Sessions and Bootcamp Boarding Programs which vary in price and all other programs, and these fees will be due on, or before, the day of services being rendered. 

4.2. Failure to provide payment on time will forfeit all scheduled session(s).

Non or Late Payments of Dog Training Fees

5.1. Non, or late payment of fees, or other charges, is a breach of this agreement.

5.2. If fees are not paid in full, the dog trainer has the right to terminate the agreement with the client, and there will be no further obligation to the client.

Cancellation, Termination of Agreement, Unforeseen Circumstances

6.1. Either party can terminate this agreement by giving the other party not less than 24 hours written notice (which may be by email to Pawzitiveteam@gmail.com) of termination. If 24 hours’ notice is not given by the client then the dog trainer has the right to charge the client $40.00 for the missed session.

6.2. Any wrongful or misleading information on the dog training application form may constitute a breach of terms of this agreement and be grounds for instant termination thereof.

6.4. Any misconduct of the client (ex; sexual harassment to trainer, words/actions of disrespect to trainer, or expectations of unreasonable or achievable results) will result in termination of this agreement. Trainer shall be entitled to retain any and all sums of money paid by client.

6.5. Termination under the circumstances described in 6.2 or 6.3 shall not entitle the client to any refunds nor relief of any outstanding payments due.

6.6. If client experiences unforeseen circumstances during training contract (ex; dog dies, is stolen, becomes terminally ill, disabled, or is rehomed) client has the right to gift remaining training sessions to a local animal shelter/rescue of their choice.

Scheduling, Rescheduling, Tardiness

7.1. To reschedule a session, Client must give staff written or verbal notice 24 hours prior to scheduled session or drop off date via email/text stating Client Name, Dog Name, reason for rescheduling, what desired dates/times for rescheduled session and/or drop off date.

7.2. Scheduling bundled training sessions can be scheduled for all sessions upon purchasing of bundle or individually (weekly, bi-weekly). Understanding, there is no guarantee desired dates/times can be accommodated when scheduled individually.

7.3. No Call – No Show and/or tardiness of 30 minutes or greater to an appointment gives Pawz-itive Dog Training the right to cancel session without notice, charge client for a full session and/or terminate training obligations.

7.4. Trainer has the right to reschedule clients at any point before or during the training session due to unforeseen circumstances.

7.5. If trainer is late to appointment 30 minutes or greater, Client has the right to reschedule appointment at no additional cost. Refund of session not permitted.

Insurance

8.1. The dog trainer will ensure that suitable and valid insurance is in place at all times. The dog trainer is covered by insurance relating to the duties of dog training within the agreed times and dates set out in the dog training form only.

Photos, Videos, Social Media

9.1. Client agrees to and allow Trainer to photograph, video and use images of Client’s dog for publication and/or promotion. Owner permanently grants Trainer the right to distribute, transmit, publish, copy, or otherwise exploit, either in whole or in part, either digitally or in any other medium now known or later discovered, any photographs and or videos of client’s dog and/or client on Trainer’s website, blog, YouTube, Facebook, LinkedIn, TikTok, Instagram, and/or any other internet medium commonly referred to as “social media”. Owner hereby releases and discharges Trainer and its agents, representatives, and assignees from any claim or cause of action, now known or later discovered, for, among other things, invasion of privacy, right of publicity, and defamation arising out of the use and exploitation of the photographs and/or videos.

Complaints, Concerns, Questions

10.1. If at any point client feels the need to express concern or state a complaint, client is willing to email Pawzitiveteam@gmail.com prior to further action being taken.

10.2. If at any point client has questions regarding training plan and or the course of training, trainer will be notified at Pawzitiveteam@gmail.com.

I have read, understood, and agree to the Dog Training Agreement and Terms and know this is a legally binding contract by submitting a training application.
